1. Intellectual Property and Promotional Use

Karigur retains full intellectual property rights to all designs and garments. You may not reproduce or commercially exploit any designs without our written consent. We reserve the right to use publicly posted photos of customers wearing our garments for promotional purposes without further notice.

2. Purchase Orders, Payments, and Deposits

  • Custom Orders (In-Store Only): A 50% non-refundable deposit is required to begin production. By making this deposit, you accept these Terms.
  • Online Orders: Full payment is required at the time of purchase. No deposits apply to online orders.

3. Return and Refund Policy

We accept returns only for manufacturing defects. All other sales are final after delivery or pickup.

4. Product Warranties and Liability

All warranties expire upon receipt of the garment. Karigur is not liable for its condition or use after leaving our store.

5. Collection and Storage

Garments not collected within 45 days after completion will be considered abandoned, and ownership will transfer to Karigur. Deposits and payments will be forfeited.

6. Dispute Resolution

All disputes must be resolved through arbitration in Mississauga, Canada. By conducting business with us, you waive the right to take Karigur to court.

Purchase Agreement

1. Deposit and Payment Confirmation:

  • Custom Orders: To commence production of custom garments, a 50% non-refundable deposit is required. This deposit serves as liquidated damages in the event of cancellation by the Purchaser due to the bespoke nature of the goods. By providing this deposit, the Purchaser acknowledges understanding and acceptance of all terms outlined in this agreement.
  • Off-the-Rack Items: Full payment is required at the time of purchase for off-the-rack items. By making this payment, the Purchaser acknowledges understanding and acceptance of all terms outlined in this agreement.

2. Design Confirmation (Custom Orders):

Upon pickup or delivery of the custom garment, the Purchaser confirms that the item matches the approved design specifications. The Purchaser acknowledges they have reviewed and are satisfied with all aspects of the craftsmanship, including fabric dye, beadwork, embroidery, and design elements. Any concerns must be communicated prior to taking ownership or within 24 hours of delivery; otherwise, the garment is accepted "as is" with no further obligations on Karigur's part.

3. Customization and Finality (Custom Orders):

Once the deposit is provided, the Purchaser confirms final approval of all design details. No modifications can be made after the deposit is received. Karigur commits to executing the design according to the agreed specifications to the best of their ability, acknowledging the handcrafted nature of the work.

4. Artisanal Craftsmanship Acknowledgment:

Karigur garments are handcrafted, resulting in natural variations in fabric dye, beadwork, embroidery, and measurements. These characteristics—including but not limited to minor color differences, falling beads, loose threads, or slight measurement discrepancies—are not considered defects. The Purchaser agrees to accept these attributes as inherent qualities of handcrafted garments for both custom and off-the-rack items, and waives any claims related to such variations.

5. Alterations and Fit:

One complimentary fitting and alteration is included with custom orders. Additional alterations or any alterations for ready-to-wear or off-the-rack items will incur extra charges. Karigur is not responsible for any alterations made by third-party tailors or service providers. For off-the-rack items, while Karigur may provide tailoring references, any alterations are the sole responsibility of the Purchaser.

6. Sales and Cancellation Policy:

All sales are final upon providing a deposit or full payment. No refunds, exchanges, or returns will be accepted once a deposit or full payment has been made. Deposits are non-refundable and non-transferable, serving as liquidated damages for cancellation by the Purchaser. If the Purchaser cancels an item within a multi-item order, the deposit for the canceled item is forfeited and cannot be applied to other items.

7. Collection and Storage:

Garments that remain uncollected 45 days after notification of completion will be considered abandoned. Ownership of such garments transfers to Karigur, and all payments made will be forfeited. Karigur will make reasonable efforts to contact the Purchaser for collection, including a minimum of seven attempts via email and/or phone, providing clear notice of the impending transfer of ownership due to abandonment.

8. Promotional Use and Credit:

Karigur reserves the right to use any publicly posted photos or videos of customers wearing our garments for promotional purposes, without further notice or consent. This includes images and videos found on platforms such as Facebook, Instagram, Snapchat, WhatsApp, TikTok, YouTube, and Pinterest. The Purchaser agrees to provide high-resolution photos and releases all model rights for promotional use to Karigur upon request.

9. Review and Reputation Protection:

The Purchaser agrees not to publish any false, malicious, or defamatory content about Karigur or its products. Should any concerns arise, the Purchaser agrees to communicate directly with Karigur to seek a resolution prior to making any public statements.

10. Liability and Indemnification:

Once the garment is delivered or collected, Karigur holds no responsibility for its condition or any subsequent use. The Purchaser agrees to indemnify and hold harmless Karigur against any claims, liabilities, or expenses arising from the use of the product.

11. Dispute Resolution:

All disputes arising from this agreement shall first undergo mandatory mediation in Mississauga, Ontario, at the Purchaser's expense. If mediation fails to resolve the issue, binding arbitration will be the next step, also at the Purchaser's expense. Litigation will only be considered if both mediation and arbitration fail to produce a resolution. The arbitration award shall be final and binding upon both parties.

12. Intellectual Property Rights:

Karigur retains exclusive design rights for all garments. The Purchaser agrees not to reproduce, replicate, or commercially exploit the design in any manner. Any infringement of Karigur's intellectual property rights will result in legal action.

13. Pickup and Ownership Transfer:

Upon pickup or delivery of the item, the Purchaser acknowledges receipt of the garment in satisfactory condition and accepts it "as is" at that time. Once the garment is collected, Karigur is not liable for its condition or any future use.

14. Care Instructions:

Spot treatment by a professional is always recommended. Do not wash or dry clean the garment, as improper care may damage the handcrafted elements.

They acknowledge that the deposit or payment is a binding commitment to the order and that the garments received will reflect the inherent qualities of handcrafted work as detailed above.
